Terms of Service
By using this website (DreamPic.AI, service) you agree to the following:
1) In general service allows you to generate pictures (results) with the
help of special software (neural network) based on the pictures you provide
as input
2) Our service takes your pictures, uses them to train StableDiffusion model
using DreamBooth algorithm and then uses the trained model to produce new
pictures based on set of special predefined condition (prompts)
3) It is impossible to predict the resulting pictures since generating algorithm
is random in its nature. The results can look weird, unnatural, completely
broken.
4) REFUNDS:
You pay for using the service, not for the generated pictures.
If you don't like the result we can't refund you, since training a model
and generating pictures requires expensive hardware that we rent to
fulfill your order.
5) AGE RESTRICTIONS:
Our service is only available to users who are at least 13 years
old. This is the minimum age for digital consent in many countries,
including the United States. If you are under 13 years old, you are not
allowed to use our service. This requirement is in place to protect the
privacy and safety of young users, and to ensure that we comply with
relevant laws and regulations. If you are a parent or guardian of a
child under 13 years old, please do not allow them to use our
service. If you are 13 years old or older and would like to use our
service, please make sure that you have obtained the appropriate consent
from your parent or guardian. By using our service, you confirm that you
meet the minimum age requirement and have obtained the necessary
consent.
6) We can't fully control the result images as the outcome of AI model is
unpredictable. You understand and accept that sometimes results may look not
like you expect.
7) If you need guaranteered quality results DO NOT USE our service.
8) You use our service with good intentions

9) We operate as SDVSOFT OU. The company registered in Rebuplic of Estonia.
10) These Terms of Service and Privace Policy can be changed as service
evolves but all changes will only apply to new orders
11) COPYRIGHT ON THE RESULTS:
We hereby grant to You a perpetual, worldwide, non-exclusive, no-charge,
royalty-free, irrevocable license to make, have made, use, offer to sell,
sell, import, and otherwise transfer the generated images.
DreamPic.AI'S SOFTWARE, APPS, WEBSITE, AND ANY OF ITS OTHER PROPERTIES ARE
PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING
BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS, OWNERS
OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY,
WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR
IN CONNECTION WITH DreamPic.AI'S SOFTWARE, APPS, WEBSITE, AND ANY OF ITS OTHER
PROPERTIES OR THE USE OR OTHER DEALINGS IN DreamPic.AI'S SOFTWARE, APPS,
WEBSITE, AND ANY OF ITS OTHER PROPERTIES.
Privacy Policy
1) We do not collect or store any private data except for the purpose of
providing the service.
2) We only process information and data provided by you directly.
3) Pictures you provided, trained model and generated results are
automatically deleted in 14 days after order is completed. You can also
initiate immediate deletion via order status page.
3) We may use Google Analytics and other marketing/monitoring tools to do
marketing related activities and/or site reliability monitoring.
4) We are required by law to store all payment related data including your
name and billing address for the period of time required by law.
Acceptable Use Policy
No unlawful or prohibited use
As a condition of your use of the Services, you will not use the Services
for any purpose that is unlawful or otherwise prohibited by this AUP. You
may not use the Services in any manner that could damage, disable,
overburden, or otherwise impair any of the Services offered by DreamPic.AI,
or any services offered by a third party, or interfere with any other
party's use and enjoyment of any of our Services. You may not obtain or
attempt to obtain any materials or information through any means not
intentionally made available through the Services.
You agree not to use the Service or Results to:
- In any way that violates any applicable national, federal, state, local
or international law or regulation;
- For the purpose of exploiting, harming or attempting to exploit or harm
minors in any way;
- To generate or disseminate verifiably false information and/or content
with the purpose of harming others;
- To generate or disseminate personal identifiable information that can be
used to harm an individual;
- To defame, disparage or otherwise harass others;
- For fully automated decision making that adversely impacts an
individual’s legal rights or otherwise creates or modifies a binding,
enforceable obligation;
- For any use intended to or which has the effect of discriminating against
or harming individuals or groups based on online or offline social behavior
or known or predicted personal or personality characteristics;
- To exploit any of the vulnerabilities of a specific group of persons
based on their age, social, physical or mental characteristics, in order to
materially distort the behavior of a person pertaining to that group in a
manner that causes or is likely to cause that person or another person
physical or psychological harm;
- For any use intended to or which has the effect of discriminating against
individuals or groups based on legally protected characteristics or
categories;
- To provide medical advice and medical results interpretation;
- To generate or disseminate information for the purpose to be used for
administration of justice, law enforcement, immigration or asylum
processes, such as predicting an individual will commit fraud/crime
commitment (e.g. by text profiling, drawing causal relationships between
assertions made in documents, indiscriminate and arbitrarily-targeted use).
